The new federal ‘Family Homes on Reserve and Matrimonial Interests or Rights Act’ is now in force as of December 16, 2014.
This new law will affect land transactions such as:
Land Transfers, New land leases and permits, Lease Assignments, Estate distributions, etc.
There are new additional forms required for the above transactions.
Assessments, Declarations and Spousal Consents must be filled out.

Moved by Greg Nadjiwon, Seconded by Cheryl Johnston,
Chippewas of Nawash Unceded First Nation Band Council hereby agree;
WHEREAS Chippewas of Nawash Unceded First Nation has from time immemorial used and occupied its land;
WHEREAS Chippewas of Nawash Unceded First Nation has the inherent right to govern itself, its members and its land;
WHEREAS Chippewas of Nawash Unceded First Nation has reserved certain lands for the exclusive use and benefit of its members;
WHEREAS Chippewas of Nawash Unceded First Nation desired to protect its members living on its reserve lands in accordance with its culture and traditions;
WHEREAS Chippewas of Nawash Unceded First Nation does not wish to be bound by the default provisions of the federal Family Homes on Reserves and Matrimonial Interests or Rights Act (Canada);
WHEREAS provincial laws respecting real property do not apply to reserve lands;
WHEREAS Chippewas of Nawash Unceded First Nation desires to provide a law appropriate to our culture and traditions respecting the use, enjoyment and occupation of family homes on its reserve lands and the division of real property right or interests held by spouses or common-law partners on reserve lands;
WHEREAS Section 7(3) of the Family Homes on Reserves and Matrimonial Interests or Rights Act requires a First Nation to notify the Provincial Attorney General of its intention to enact a Law under the Act;
THEREFORE, BE IT RESOLVED that the Chippewas of Nawash Unceded First Nation affirms it intent to commence development of the Chippewas of Nawash Unceded First Nation Matrimonial Real Property Law.
